Website and Direct Accommodation Bookings

1. Introduction

These Terms & Conditions (“Terms”) govern your use of www.buenavistaholidays.com (the “Website”) and direct accommodation bookings made through it. The Website is operated by Buena Vista Holidays Limited (“Buena Vista”, “we”, “us” or “our”), a company registered in Malta under company registration number C76834, VAT number MT 2356 6411, with offices at 15, ix-Xatt ta’ Qui Si Sana, Sliema, Malta.

By using the Website or making a booking, you (“Guest”, “you” or “your”) agree to these Terms. These Terms should be read together with the booking confirmation, the cancellation conditions displayed for the selected rate, any property-specific House Rules, our Guest Privacy Notice and our Cookie Policy.

If there is an inconsistency, the property-specific and rate-specific terms shown to you before you complete the booking will prevail to the extent of that inconsistency, except where mandatory law provides otherwise.

2. Our Role and the Accommodation Provider

Buena Vista offers accommodation under more than one operating model. Some properties are leased or otherwise held and operated by Buena Vista in its own right. Other properties are owned by third parties and are operated and/or managed by Buena Vista under an agreement or other lawful title derived from the owner.

For each direct booking made through the Website, Buena Vista is responsible for administering the booking and for providing or arranging the accommodation and guest services described in the booking confirmation. Where required by applicable law or by the licensing structure of a particular property, the relevant proprietor, licence holder or accommodation operator may also be identified in the property listing, booking confirmation or other pre-contract information.

Nothing in these Terms is intended to misrepresent the identity of the legally responsible accommodation operator or to exclude any rights that a Guest has under mandatory Maltese or EU law.

3. Booking Process and Formation of Contract

3.1 A booking request is subject to availability and acceptance. A binding booking is formed only when Buena Vista issues a written booking confirmation by email or through the Website.

3.2 Submission of a booking request, card details or payment does not by itself oblige Buena Vista to accept the booking.

3.3 You must be at least 18 years old and legally capable of entering into the booking contract. The person making the booking is responsible for ensuring that all members of the party comply with these Terms and the applicable House Rules.

3.4 All information supplied during booking, including guest names, number of occupants, ages where relevant, dates and contact details, must be accurate. We may refuse or cancel a booking where material information is false, misleading or incomplete, subject to applicable law.

3.5 Obvious pricing, availability, description or technical errors do not bind Buena Vista where a reasonable person would have recognised the error. If such an error affects a confirmed booking, we will contact you promptly and, where legally permissible, offer the option of proceeding on the corrected terms or receiving a refund of amounts paid.

4. Prices, Deposits and Payments

4.1 Unless otherwise stated before booking, the accommodation price displayed includes the applicable VAT on the accommodation service. Any mandatory tax or contribution that must by law be shown separately will be separately itemised.

4.2 Unless a different payment schedule is displayed for the selected rate, a deposit of 35% of the total booking price is due at the time of booking and the remaining balance is due no later than one day before arrival.

4.3 We accept the payment methods displayed at checkout. You authorise us and our payment service providers to process amounts falling due under the booking.

4.4 If a payment is declined, reversed or not received when due, we may request alternative payment and, after reasonable notice where appropriate, cancel the booking in accordance with the applicable booking conditions.

4.5 Promotional codes, discounts and special offers are subject to their stated conditions, availability and expiry dates and may not be combined unless expressly stated.

5. Environmental Contribution and Other Mandatory Charges

5.1 Malta’s Environmental Contribution is charged separately from the accommodation price at the rate, and subject to the cap, prescribed by Maltese law from time to time.

5.2 As at the date of these Terms, the contribution is €1.50 per night for each person aged 18 or over at the start of the visit, subject to a maximum of €22.50 per person per visit.

5.3 The contribution is a statutory charge and is shown separately from the accommodation rate. If the applicable law, rate, cap or collection mechanism changes between booking and stay, the legally applicable amount and collection procedure will apply.

6. Security Deposit, Damage and Additional Charges

6.1 A security deposit may be required for a booking. Unless otherwise stated, it is taken as a card pre-authorisation rather than a separate charge. The applicable amount will be communicated before or in connection with check-in.

6.2 After check-out, we will arrange for the accommodation to be inspected and will release any unused pre-authorisation as soon as reasonably practicable. The time taken for the released amount to disappear from your account is controlled by your card issuer or bank and may take several weeks.

6.3 You and the members of your party are responsible for reasonable costs arising from loss or damage caused during the stay beyond normal wear and tear. This may include, where applicable:

  • damage to the accommodation, furniture, fixtures, equipment or common areas;
  • missing items, lost keys or access cards and reasonable locksmith or replacement costs;
  • smoking or vaping contrary to the House Rules, including reasonable deodorising or specialist cleaning costs;
  • excessive cleaning beyond what would ordinarily be required after a stay;
  • damage or additional costs caused by unauthorised guests, parties, pets or misuse of the property; and
  • reasonable call-out or third-party charges caused by the Guest’s misuse, negligence or breach of these Terms or the House Rules.

6.4 We may apply all or part of the security deposit towards properly evidenced and reasonable charges. Where the amount due exceeds the security deposit, you remain responsible for the balance. Nothing in this clause permits Buena Vista to impose arbitrary or disproportionate charges.

7. Cancellation by the Guest, No-Shows and Refunds

7.1 The cancellation policy displayed for the particular property and rate at the time of booking forms part of your contract and takes precedence over any general cancellation wording on the Website.

7.2 Where the selected rate provides for free cancellation, partial cancellation charges or a non-refundable rate, those conditions will be shown before you complete the booking and in the booking confirmation.

7.3 Unless the applicable rate states otherwise, a no-show may be charged up to the full booking amount.

7.4 For accommodation booked for a specific date or period, the statutory 14-day withdrawal right that applies to certain distance contracts does not generally apply. Your cancellation rights are therefore governed by the cancellation conditions applicable to your booking and by any mandatory rights under applicable law.

7.5 Refunds properly due will be made using the original payment method where reasonably possible. Processing times after a refund is issued may depend on banks, card schemes and payment providers.

8. Cancellation or Material Change by Buena Vista

8.1 We may need to cancel or materially change a confirmed booking where the accommodation becomes unavailable, unsafe, unlawful to operate or unsuitable for occupation, or where another circumstance makes performance impossible or materially impracticable.

8.2 Where this occurs before or during the stay, we will act reasonably and, depending on the circumstances and applicable law, seek to offer one or more of the following:

  • comparable alternative accommodation, where reasonably available;
  • a refund of the affected accommodation amount; or
  • another reasonable remedy agreed with the Guest.

8.3 If we offer alternative accommodation, we will take reasonable account of location, size, facilities and overall standard. Exact equivalence cannot always be guaranteed.

8.4 Nothing in this section limits any mandatory consumer remedy that cannot lawfully be excluded.

9. Check-In, Check-Out and Guest Registration

9.1 Standard check-in is from 3:00 PM and standard check-out is by 11:00 AM, unless different times are shown for the property.

9.2 Late check-in or late check-out may be subject to a fee where this is disclosed in advance. Late check-out is subject to availability and must be expressly confirmed.

9.3 You must complete any identification and guest-registration requirements required by Maltese law. You agree to provide accurate identification and other information reasonably required for lawful registration, licensing, security or compliance purposes.

9.4 Access instructions, keys, codes and access cards are for registered guests only and must not be shared with unauthorised persons.

10. Occupancy, House Rules and Use of the Property

10.1 The accommodation may be occupied only by the number of persons permitted by the applicable licence, listing and booking confirmation. Unregistered overnight guests or visitors may be prohibited or restricted by the property-specific House Rules.

10.2 The House Rules displayed on the property listing or supplied before or at check-in form part of the booking contract. They may include rules relating to noise, quiet hours, smoking, vaping, pets, parties, visitors, waste, balconies, pools, common areas and building regulations.

10.3 You must not:

  • hold an unauthorised party, event or commercial activity at the property;
  • cause unreasonable noise, nuisance, harassment or disturbance to neighbours, other guests or building occupants;
  • engage in illegal activity or use the accommodation for an unlawful purpose;
  • exceed permitted occupancy or sublet, transfer or resell the accommodation;
  • tamper with smoke detectors, fire equipment, security systems, utilities or safety devices; or
  • deliberately or recklessly damage the property or common areas.

10.4 Guests must comply with reasonable condominium, building, pool, parking and common-area rules notified to them.

10.5 Parents and guardians remain responsible for the supervision and conduct of children and minors in their party.

11. Right to Refuse Entry or Terminate a Stay

11.1 We may refuse entry or terminate a stay where the lead Guest or a member of the party materially or repeatedly breaches these Terms or the House Rules, engages in illegal or threatening conduct, creates a serious nuisance, exceeds permitted occupancy, holds an unauthorised party, or creates a material risk to persons or property.

11.2 Where circumstances reasonably permit, we may first request that the breach be remedied. Immediate termination may be appropriate for serious breaches, safety risks, violence, threats, illegal activity or serious disturbance.

11.3 Where a stay is lawfully terminated because of the Guest’s material breach, the Guest may lose entitlement to a refund for the unused portion of the stay, subject always to mandatory law. We may contact building security, the police or other competent authorities where reasonably necessary.

12. Maintenance, Emergency Access and Property Protection

12.1 You must report defects, leaks, damage, safety concerns or maintenance issues as soon as reasonably possible.

12.2 Buena Vista staff, the property owner, building management or authorised contractors may access the accommodation at reasonable times where reasonably necessary for inspection, maintenance, repair, compliance or protection of the property. We will give reasonable notice where circumstances permit.

12.3 Advance notice may not be possible in an emergency or where immediate access is reasonably required because of a suspected water leak, fire, electrical or gas hazard, security incident, welfare concern, serious nuisance or risk of damage.

13. Complaints and Problems During the Stay

13.1 If you experience a problem with the accommodation or services, please contact our Guest Experience Team as soon as reasonably possible during the stay and provide sufficient information for us to investigate.

13.2 You should allow us a reasonable opportunity to remedy a problem where a remedy is possible. Depending on the issue, this may involve maintenance, cleaning, replacement of an item or, in appropriate cases, alternative accommodation.

13.3 Failure to report an issue promptly may affect our practical ability to investigate or remedy it, but nothing in this clause removes any statutory right that cannot lawfully be waived.

14. Property Descriptions, Photographs and Amenities

14.1 We take reasonable care to ensure that descriptions, photographs and amenity information are accurate. Photographs are intended to provide a fair representation, but minor changes to furniture, decoration, appliances or layout details may occur.

14.2 We do not guarantee that external surroundings, views or neighbouring premises will remain unchanged after photographs are taken.

14.3 Wi-Fi, lifts, swimming pools, gyms, garages, communal systems, air-conditioning systems and other facilities may sometimes be supplied or controlled by building managers, utilities or third parties. Temporary interruption or maintenance may occur. We will take reasonable steps within our control to assist, but the remedy available will depend on the seriousness, duration and circumstances of the interruption and applicable law.

14.4 Special requests are subject to availability and are not guaranteed unless expressly confirmed by us in writing.

15. External Noise, Works and Neighbouring Activity

15.1 Urban accommodation may be affected from time to time by traffic, road works, construction, neighbouring premises, restaurants and bars, public events, church bells or other external activity outside our reasonable control.

15.2 We do not guarantee a completely noise-free environment. Where we are aware before booking of a specific external circumstance that is reasonably likely to have a material effect on the stay and which should fairly be disclosed, we will take reasonable steps to provide appropriate information.

16. Third-Party Services

16.1 Airport transfers, tours, vehicle hire, equipment hire and other ancillary services may be supplied by independent third parties.

16.2 Where we merely arrange or facilitate such a service, the third party’s own terms may apply and that provider is responsible for performing its service, subject to any responsibility Buena Vista cannot lawfully exclude.

16.3 Nothing in this section affects any rights you may have against Buena Vista where, under applicable law, Buena Vista is itself legally responsible for the relevant service.

17. Guest Belongings, Lost Property and Travel Insurance

17.1 Guests are responsible for taking reasonable care of their money, valuables, travel documents and personal belongings. We do not accept liability for loss or theft except to the extent caused by our breach of legal duty or where liability cannot lawfully be excluded.

17.2 Items found after check-out may be retained for a reasonable period. Return postage, courier and handling costs may be charged to the Guest. Perishable, unsafe or low-value items may be disposed of reasonably.

17.3 We strongly recommend appropriate travel insurance covering cancellation, medical expenses, personal belongings and other travel risks.

18. Liability

18.1 Buena Vista is responsible for losses that are a reasonably foreseeable consequence of our breach of contract or legal duty, subject to these Terms and applicable law.

18.2 We are not responsible for losses that result from the Guest’s own act or omission, from information the Guest failed to provide, or from events outside our reasonable control, except where applicable law provides otherwise.

18.3 We are not liable for business losses, loss of profit, loss of business opportunity or other commercial losses where the booking is made by a consumer for private purposes.

18.4 Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, wilful misconduct, or any other liability or consumer right that cannot lawfully be excluded or limited.

18.5 Any limitation of liability in these Terms must be interpreted and applied only to the extent permitted by Maltese and applicable EU law.

19. Force Majeure and Events Outside Our Reasonable Control

19.1 Buena Vista will not be liable for a failure or delay caused by an event outside its reasonable control to the extent permitted by law. Such events may include severe weather or natural disaster, fire, flood, epidemic or pandemic restrictions, war or civil emergency, government action, strikes, transport disruption, major electricity, water or telecommunications failures, and failures of building or communal infrastructure outside our reasonable control.

19.2 Where such an event materially affects a stay, we will take reasonable steps to mitigate its impact and will consider any remedy required by the booking contract and applicable law. This clause does not remove a Guest’s mandatory right to a refund or other remedy where such a right applies.

20. Tourism Licensing and Legal Compliance

20.1 Accommodation offered through the Website is subject to the applicable Maltese tourism licensing and operating framework, including the Malta Travel and Tourism Services Act (Cap. 409) and the Tourism Accommodation Regulations, 2026 (S.L. 409.24), as applicable.

20.2 Guests must comply with lawful occupancy, registration, safety, waste, noise and other requirements applicable to the accommodation.

20.3 Where a registration number, licence number or other regulatory identifier is legally required to appear on a listing or promotional material, it will be displayed in accordance with the applicable requirements.

21. Privacy and Communications

21.1 Buena Vista Holidays Limited is the controller of personal data processed in connection with the Website and direct bookings, except where another entity acts as an independent controller under applicable law. Personal data is processed in accordance with our Guest Privacy Notice, the General Data Protection Regulation (EU) 2016/679 (GDPR), the Data Protection Act (Chapter 586 of the Laws of Malta) and other applicable data-protection law.

21.2 In connection with a booking or enquiry, we may process information including identity and contact details, account information, booking and stay information, payment-related information, technical data, marketing and communications preferences, and other information voluntarily provided by you, as more fully described in our Guest Privacy Notice.

21.3 Where reasonably necessary to administer or provide the accommodation and related services, personal data may be shared with relevant property owners, their agents, building or property managers, local service providers, payment providers, IT and software service providers and other recipients identified in our Guest Privacy Notice. Where a property is managed for a third-party owner, only information reasonably necessary for the relevant purpose should be shared with that owner or its authorised representatives.

21.4 You agree that we may contact you using the email address, telephone number, messaging service or account details supplied in connection with your booking for booking administration, payment, check-in, guest registration, security, compliance, maintenance and guest-service purposes. These service communications are separate from optional direct-marketing communications.

21.5 Marketing communications are sent in accordance with applicable law and your marketing preferences. Where consent is the applicable basis, you may withdraw that consent or opt out at any time by using the unsubscribe mechanism in the communication or by contacting us. Opting out of marketing will not prevent us from sending communications that are necessary to administer an existing booking or provide requested services.

21.6 Our Website uses cookies and similar technologies as described in our Cookie Policy. Strictly necessary cookies may be used without consent where permitted by law. Functional, analytical and other non-essential cookies or tracking technologies are used only in accordance with the consent choices presented through our cookie banner and applicable law.

21.7 Cookie preferences may be changed or withdrawn using the cookie-consent controls made available on the Website. Refusing or disabling certain non-essential cookies may affect some Website features, but will not affect cookies that are strictly necessary for the Website to operate.

21.8 The Website may contain links to third-party websites or services. Those third parties may process personal data under their own privacy notices and terms. Guests should review the relevant third-party information before using those services.

21.9 The Guest Privacy Notice and Cookie Policy form part of the information governing use of the Website but do not reduce or replace the contractual provisions of these Terms. If there is any inconsistency concerning the processing of personal data or cookies, the Guest Privacy Notice or Cookie Policy, as applicable, will govern that privacy or cookie matter, subject always to applicable law.

22. Intellectual Property and Website Use

22.1 Website content, including text, photographs, branding, graphics and design, is owned by, licensed to or otherwise lawfully used by Buena Vista and is protected by applicable intellectual-property law.

22.2 You may use the Website for personal booking and information purposes. You may not reproduce, scrape, republish, commercially exploit or misuse Website content without permission, except where permitted by law.

22.3 You must not attempt to interfere with the security, operation or availability of the Website.

23. Changes to These Terms

23.1 We may update these Terms from time to time. Updated Terms apply to Website use after publication and to bookings made after the updated Terms take effect.

23.2 The Terms applicable to an existing confirmed booking are generally those in force when the booking was confirmed, together with any property-specific or rate-specific conditions accepted at that time, unless a later change is required by law or is expressly agreed with you.

24. General Provisions

24.1 Severability. If any provision of these Terms is held invalid or unenforceable, the remaining provisions will continue to apply.

24.2 No waiver. A failure or delay by Buena Vista in exercising a contractual right does not amount to a waiver of that right.

24.3 Assignment. You may not transfer a booking to another person without our prior consent, except where applicable law provides otherwise. Buena Vista may transfer its rights or obligations where this does not reduce the Guest’s mandatory rights.

24.4 Entire agreement. These Terms, the booking confirmation, the applicable rate and cancellation conditions and the property-specific House Rules constitute the contractual terms governing the direct booking, subject to mandatory law.

25. Governing Law and Disputes

25.1 These Terms and direct bookings made through the Website are governed by the laws of Malta.

25.2 The Maltese courts shall have jurisdiction, subject to any mandatory jurisdictional rights available to consumers under applicable Maltese or EU law. Nothing in these Terms deprives a consumer of mandatory protections available under the law applicable to that consumer.

25.3 Before commencing formal proceedings, we encourage Guests to contact us so that we can attempt to resolve the matter directly.
